The Instinct to Explain Yourself Is the Instinct to Convict Yourself

Should You Talk to Police Without a Lawyer

It’s believed that, by engaging with the police, most people would be able to clear up things sooner had they not done anything wrong. In about 25% of cases where defendants were wrongfully convicted and subsequently corrected through the use of DNA, false confession, false admission, or damning statement to police was considered a root cause for these errors, according to the Innocence Project.

They weren’t hardened criminals playing the game, but lowly citizens seeking an end to their nightmare if they would cooperate.

The pressure in each of the rooms put together for interrogations is the same. When people play nice, everyone feels good, when people don’t speak, everyone feels guilty, and both instincts are wrong, focussing on the wrong issues. Much of defense attorneys’ lives are devoted to clean-up.

Cooperation Feels Right and Silence Feels Wrong

Tendency to talk is like gravity. A Politely-phrased question triggers the social ‘rule’ to answer and refusing to do that may seem rude, evasive and suspicious. Unwillingness to mend the misconception prevails from the innocent populace, particularly.

Until you’re the other person, defense attorneys experience that spirit on a weekly basis. Someone that does nothing gives a state virtually no give away. Someone who explains, makes alibis, or speculates gives the state a transcript. The two results are drastic.

Silence wins here. Not as evidence of innocence, but in order to have all the options which a lawyer will need at a later stage.

Explaining Yourself Feels Productive, But It Isn’t

If you have a story to tell at the station, then that becomes your story. Under stress, memory is at best confused. In this manner you’ll end up with a small lie in the end: a receipt or a camera will show time, order or stop to be incorrect, and it will seem like a lie the rest of the way.

When you’ve said something that people think they can count on, you need to remember that the interrogator will then change your demeanor from friendly to accusing. The Miranda decision was put in place because the Supreme Court learned that the person being questioned has a strong advantage in custodial questioning. This warning is not just a phrase: it is an actual warning. Normally, it will be waived by most.

One narrow case in which you will be able to explain the wins to the benefit of the lawyer that has vetted your communication, walked you through and knew that the statement was going to be helpful. Otherwise there can be no downside and no upside.

“Just Answer a Few Questions” Versus a Full Interview

A discussion on a porches is the same discussion formally conducted at a station.A verbal discussion on a porches is the same formal discussion in a station. All your words in either will be used against you. The differences lie in how much the light is being pressed down, and in the quality of recording. The following is a longer and more scripted version of the same event, which is better retained for a jury.

  • The casual doorstep chat. Is relaxed and people talk casually. Probable cause is being accumulated as it happens. No information you provide will be privileged.
  • The “come down to clear this up” invitation. This is technically to be voluntary. After the initial “opening” there is a new tone in the space. Passers-by witnesses at times become defendants.
  • The formal custodial interview. Let’s take a moment here to see how the record builds, and where the lawyer makes all the difference in the world in how the conversation continues.

Only one of the three has a mandatory pause inbuilt. The other two are based on you calling them.

Innocence Is Not Armor

It’s the worst thing a suspect can think, that they’re innocent, therefore there is no problem with them making a bad statement. There are too many instances of false confession from innocent individuals to be underestimated, and there does exist a known body of work and law to record such occurrences.

The rhythm is monotonous, the settings are uniform: long hours, no sleep, isolation, minimisation and the prescription that it is best to own up quickly, so as to get home again. Rather, it’s when you are tired that you will say just about anything to get out of an ill-conceived discussion, which isn’t a night’s sleep for an innocent!

Few would argue otherwise, and that’s because experienced defense attorneys are nearly unanimous. Rightology is to invoke, out loud and clearly and then to say nothing more until counsel comes. This sentence has meaning: “I want a lawyer”. Don’t add any elements to them.

When Talking Actually Helps

There is such thing as a successful cooperation model – and it is different from the one you see on the side of the road. It occurs later, once counsel has looked at the discovery, evaluated the state’s evidence and has worked out what the client can and cannot safely add to his account.

A proffer, testifying at trial, or a written statement is sometimes the answer to the question. It’s all negotiated; it’s not volunteered. The pattern defense attorneys desire more folks know is simple to comprehend. End the discussion with the words, and then call an experienced defense attorney before saying another word.

Nothing will be gone-the story you want to tell will remain the next day. The one that you don’t tell will not be retrieved. Cooperation has a time and a place.

The nighttime side of a team car, without lawyers, isn’t it.
